These Terms of Service ("Terms") govern your access to and use of the Zealifi RTO Management Platform ("Service") operated by Australian Consulting & Training Solutions Pty Ltd (ABN 123 456 789) ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
To use the Service you must register for an account. You agree to:
You must be at least 18 years old and have the authority to bind your organisation to these Terms. The Service is intended for use by registered training organisations and educational providers operating in Australia.
The Service is offered on a subscription basis. By selecting a paid plan, you authorise us to charge your nominated payment method on a recurring monthly basis.
All prices are in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise. GST will be added where applicable.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
We reserve the right to suspend or terminate accounts that breach these restrictions without notice.
Your use of the Service involves the collection and processing of personal information. Our Privacy Policy describes how we collect, use, and protect that information and forms part of these Terms.
With respect to Student Data:
The Service, including all software, design, text, and graphics, is owned by or licensed to Australian Consulting & Training Solutions Pty Ltd. Nothing in these Terms grants you any right, title, or interest in the Service other than the limited right to use it as set out here.
You grant us a limited, non-exclusive licence to use your data solely to provide and improve the Service. We do not claim ownership of your data.
The Service integrates with third-party providers including Stripe (payments), Twilio (SMS), Amazon Web Services (document storage), and Supabase (database infrastructure). Your use of features that involve these providers is also subject to their respective terms and privacy policies. We are not responsible for the actions or omissions of third-party providers.
We aim to provide a reliable service but do not guarantee uninterrupted or error-free access. We may perform scheduled or emergency maintenance which may temporarily interrupt access.
Support is provided by email at info@zealifi.au.com. Enterprise plan subscribers receive priority support and service level commitments as agreed separately.
To the maximum extent permitted by law (including the Australian Consumer Law):
Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded under the Australian Consumer Law or other applicable legislation.
Either party may terminate these Terms at any time:
Upon termination, your right to access the Service ceases immediately. You may request an export of your data within 30 days of termination. After this period, we may delete your data in accordance with our data retention policy.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any disputes arising from these Terms or your use of the Service.
